This is not correct, its called “public Intoxication” and even if you are not completely intoxicated, that is how it will be filed. Your only recourse is a lab test which will likely reveal any illegal substances in your system. If you beat the drunk test the cop will claim you were intoxicated and mearly recovered due to the time it took to get the test. If you have anything in your system you will be charged and you will loose. I have seen this happen to several of the employees that have worked for me.
