
5. Promising a paid position to an intern
This can be viewed as an illegal and unpaid training period which ca be punished with federal laws.
6. Discriminate
They cannot discriminate against any employees based on: religion, color, sex, nationality, age, disability.
This information cannot be used or asked during the hiring process, setting the salary or making a promotion.
7. They can’t let you go if you filed a legal or disciplinary action against them
That is like adding fuel to the fire.
8. They can’t treat you as an employee if you are independent contractor
Hiring an independent contractor as opposed to hiring an employee, will cost the firm or employer less money.
Which is why they can’t expect from you to do the same business as a worker would.
9. Scold you if you complain or talk about them on social media
You are legally allowed to talk about your work place publicly, social media included.
10. Ask them to work off clock
It is illegal for them to ask from you to work outside your shift.

Hello, my name is Joseph.
I don’t know how to really put this, but I’ll do my best. I was released or let go from this automotive dealership after being employeed there for a little over three years. I was promoted to a Lead position within my first year, then COVID-19 hit. Out of 20 sum auto Technicians, I was 1 of 4 selected to work during the COVID-19 Shut Down.
Shortly after everyone was given the green light to come back to work, I was informed that we lost our Service Manager,(my immediate supervisor).
So, trying to make it short as possible. In the three years working there, I’ve been through, and worked under, I believe it’s like 6 or 7 different managers. Every single one of them handed/gave my position and higher pay to another Technician with me, finding out from other Technicians. The last one was the slap in the face. That Manager was already employed there as the Assistant Manager and aware of everything and everyone’s work station and duties. Management was well aware of my personal issues I was going through. Custody battle with my 1st ex-wife, process of 2nd divorce(losing everything, including my vehicle for work and visitation with my kids). That Manager held a mandatory crew meeting during all of that. That’s where and when I lost my position again, but this time to a 19 year old girl, who he, my former manager, brought in from another dealership he came from. Not only did she take my job from me she recieved pay well passed what I was given. I I formed Management about her and another tech, smoking Marijuana on company grounds during their breaks. If I. Not mistaken, was reported by customer(s), too.
Was he in the WRONG, for letting go like that? Oh, and never received my last paycheck also, till this day.
My company recently announced an across the board raise to reflect the economic growth since Covid 19. I have been employed by this hospital 18 + yrs. I was told I wouldn’t be eligible because of absenteeism. My yearly evaluation is in April. Is this common practice? To withhold economic recovery benefits for diciplinary reasons?
