If the property you’re about to buy doesn’t have an easement in place, it’s best to talk to a local real estate lawyer. (Make sure he/she can be trusted!) Obtaining an easement is not as easy as it seems, but a real estate lawyer will know the odds of getting one.

Here’s what could happen in the attempt of getting an access easement:

  • The adjacent landowner doesn’t want to give you access; therefore, you have no other choice than to file a lawsuit for getting the easement.
  • Your real estate lawyer could talk to the adjacent landowner in order to obtain the easement. And yes, you will still have to pay the fees for your lawyer, but it’s cheaper than a lawsuit.
  • Or trying to get along with the adjacent landowner. It’s the easiest way, but it doesn’t work every time.
