4. Who is actually responsible for maintaining an easement?

By now, we can all agree that easements convey specific rights; however, they also come with many responsibilities, including maintenance.

In general, the person or party using an access easement, a.k.a. the easement holder, is responsible for maintaining the easement. What most people fail to understand is that easement holders do not become the landowners of the piece of the property mentioned in their easements.

So, it might be your responsibility as an easement holder to maintain it, but it’s not yours. Think of it as renting a suit: you’ll wear it, but it’s not yours.
