7. Consider whether you’ll be able to collect on a court judgment

In most cases, it doesn’t make any sense to file a lawsuit if you think you won’t be able to collect on a court judgment. When your lawsuit is over, and it’s in your favor, the judge will most likely issue a judgment against the defendant and other parties participating in the lawsuit for payment.

Based on that judgment, you’ll get your money back for court costs and other things. Unfortunately, oftentimes the losing party is reluctant to pay (for obvious reasons). So, make sure the company/person you sue has enough assets and money to satisfy any judgment you may receive in court.
