6. Think about whether the defendant can sue you back

Maybe the company thinks that they are “the victim,” not you. So they might sue you for malicious prosecution, saying that you’re destroying their reputation with your allegations. Of course, they need reasonable grounds to do so. That’s why it’s important to determine from the beginning whether they can sue you back or not.

If the defendant sues you back, imagine that you need to double everything (time, money, and energy) for a separate lawsuit. Can you do that?

P.S.: They can also sue you back in the same lawsuit, and this is generally referred to as a counterclaim.
